Abstract

In the parliamentary system, the Council of Ministers is a model of dual executive power and its work is based on cooperation. The Council of Ministers is represented by a collective and solidarity body that takes decisions by majority. The Council of Ministers consists of the Prime Minister, his deputies, and ministers. Once the Prime Minister is chosen, he begins to exercise his first administrative work by nominating members  The Council of Ministers is based on the constitutional texts. However, the Iraqi reality is not without political, sectarian and national considerations in the formation of the Council of Ministers.

The constitution organized everything related to the position of the president of the republic or most of it, and perhaps that was because of what the Iraqis suffered from the presidents of the republic who ruled Iraq before, and thus prevented the return of dictatorship and tyranny again, but the constitution did not regulate the position of the prime minister explicitly as it did with the president  The Republic, the constitutional texts that referred to the Prime Minister need interpretation to remove ambiguity from many of them, as they are vague and loose and need to complete what is lacking in them.  .

This research deals with the conditions that must be met by whoever is nominated for the position of Prime Minister, and it also discusses the mandate of the Prime Minister, and finally deals with the competencies set by the Constitution for the Prime Minister, and then we conclude it with a conclusion in which we explain the most important results and recommendations.
