Abstract :

Our research addresses the criminal penalties for the damage caused by medical waste, which is considered one of the most serious threats to the environment and public health due to its content of hazardous and infectious chemicals. This has prompted the legislator to establish a comprehensive penal system aimed at reducing violations and ensuring compliance with health and environmental regulations in the handling of medical waste. These penalties vary according to the severity of the act and its consequences. They can reach the most severe penalties if they result in a widespread threat to the environment and public health, such as penalties involving death (execution) and penalties involving deprivation of liberty, such as imprisonment, in cases of negligence or serious violation. In addition, financial penalties such as fines are imposed to deter and reduce profits. The consequences of these violations and the confiscation of the means used to dispose of these violations. The role of the law is not limited to imposing penalties only, but extends to include precautionary measures taken when these damages are proven, such as publishing judicial rulings in order to raise awareness of the seriousness of these actions, closing the facility and prohibiting the practice of the activity. What we conclude in our research topic is the necessity of establishing strict criminal penalties to confront the damages of medical waste in a way that achieves deterrence and protection.
