Abstract

Ai-khaigrat is an important issue in lslamic jurisprudence and law lt has important and overlapping issues in many contracts such as sales and other contracts . however there is a difference in lslamic jurisprudential opinion and lagal jurisprudential opinion on many issues including the issue of inheriting the option aftar the death of the one who has the option in the contract . lslamic jursprudence has differed regarding whether options are inherited or not some say that all types of options are inherited and some say only some of them are inherited for a specific reason and likewise the civil law is a section thet did not take into account the options which are hidden loopholes inherited form lslamic jurispudence and some of them took some and not others we chose jaafari jurispudence because it inherit all types of options. Based the iraqi civil law , the jordanian civil law and yemeni civil law , we examine why jaafari jurispudence decided to inherit all options and the what is the reason that motivites that we also examine the opinion of the iraqi ,jordanian,and yemeni legislater because the yemeni legislator is compatible jaafari jurispudence opinion .
